Welcome to Xchange Deliveries. These Terms constitute a legally binding agreement between you ("User") and Xchange Deliveries regarding your use of our website, mobile application, and delivery services.
1. User Accounts
To access certain features (ordering food or sending packages), you must register an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Notify us immediately if you discover any security breach.
2. Food Delivery Services
Xchange Deliveries acts as an intermediary between you and independent Restaurants ("Vendors").
- Quality: The Vendor is solely responsible for the quality, safety, and preparation of the food. Xchange Deliveries is not liable for food quality issues.
- Availability: All menus are subject to availability. If an item is out of stock, we may contact you to arrange a substitute or refund.
- Allergies: It is your responsibility to check menu descriptions for allergens. We cannot guarantee 100% allergen-free environments in partner kitchens.
3. Logistics & Errands
When using our "Send Package" or "Run Errand" service, you warrant that you are the owner of the goods or have the authority to send them.
Prohibited Items
You strictly agree NOT to send the following items via our network:
- Illegal drugs, narcotics, or psychotropic substances.
- Firearms, explosives, or flammable materials.
- Stolen property or items prohibited by Nigerian Law.
- Cash in excess of ₦10,000,000 (We are not a cash-in-transit service).
Xchange Deliveries reserves the right to inspect packages and report suspicious items to law enforcement agencies.
4. Payments & Refunds
Payments are processed securely via third-party gateways (Paystack).
- Charges: Prices for goods and delivery fees are displayed at checkout. Total amounts may include tax.
- Refunds: Refunds are processed only if:
- The order was cancelled before the restaurant started preparation.
- The delivery was significantly delayed due to our fault (excluding traffic/weather).
- Items were missing from the order.
5. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Nigeria.
